Public Notice - Amending Zoning Ordinance and Map

PUBLIC NOTICE  

Notice is hereby given that the Board of Supervisors of Upper Southampton Township, County of Bucks, Commonwealth of Pennsylvania, will hold a public hearing on March 10, 2020 at 6:30 PM in the Southampton Free Library, lower level meeting room, 947 Street Road, Southampton, PA 18966 to consider adoption of the following ordinance:

AN ORDINANCE OF THE TOWNSHIP OF UPPER SOUTHAMPTON, COUNTY OF BUCKS, COMMONWEALTH OF PENNSYLVANIA, AMENDING UPPER SOUTHAMPTON TOWNSHIP ZONING ORDINANCE AND MAP ATTACHED THERETO BY RECLASSIFYING FROM R-4 MODERATELY HIGH DENSITY RESIDENTIAL DISTRICT TO THE CC CONTROLLED COMMERCIAL DISTRICT  A TRACT OF LAND CONSISTING OF A BUCKS COUNTY TAX MAP PARCEL NO. 48-017-017 SITUATE IN THE TOWNSHIP OF UPPER SOUTHAMPTON

UPPER SOUTHAMPTON TOWNSHIP

    ORDINANCE NO.

AN ORDINANCE OF THE TOWNSHIP OF UPPER SOUTHAMPTON, COUNTY OF BUCKS, COMMONWEALTH OF PENNSYLVANIA, AMENDING UPPER SOUTHAMPTON TOWNSHIP ZONING ORDINANCE AND MAP ATTACHED THERETO BY RECLASSIFYING FROM R-4 MODERATELY HIGH DENSITY RESIDENTIAL DISTRICT TO THE CC CONTROLLED COMMERCIAL DISTRICT  A TRACT OF LAND CONSISTING OF A BUCKS COUNTY TAX MAP PARCEL NO. 48-017-017 SITUATE IN THE TOWNSHIP OF UPPER SOUTHAMPTON

WHEREAS, the Board of Supervisors of the Township of Upper Southampton, County of Bucks, Commonwealth of Pennsylvania, is empowered to enact and amend zoning ordinances to implement the Comprehensive Plan of said Township, and to accomplish the purposes of the Pennsylvania Municipalities Planning Code, as amended; and 

WHEREAS, it is the intent, purpose, and scope of said Code to protect and promote safety, health and morals, to accomplish a coordinated development of municipalities, to provide for the general welfare by guiding and protecting amenity, convenience, future governmental, economic, practical, and social and cultural facilities, development and growth, and to guide uses of land and structures, public grounds, and other facilities; and  

WHEREAS, Applicant, as part of a Subdivision and Land Development Plan titled “912 Street RD LLC - Proposed Chase Bank”,  has requested a change in the zoning classification of  Bucks County Tax Map Parcel #48-017-017 from R-4  High Density Residential  District to CC Controlled Commercial District; and

WHEREAS, as part of the said Plan, Bucks County Tax Map Parcel #48-017-017 will be combined with Bucks County Tax Map Parcel #48-017-018, which is zoned CC Controlled Commercial District, with the combined parcels being the location of a branch of Chase Bank; and

WHEREAS, the Board of Supervisors of Upper Southampton Township has determined that it is appropriate to change and return the zoning classification of a portion of Bucks County Tax Map Parcel #48-017-017 from R-4  High Density Residential  District to CC Controlled Commercial District.

NOW THEREFORE, the Board of Supervisors of the Township of Upper Southampton, County of Bucks, Commonwealth of Pennsylvania, does hereby ordain and enact the following:

Section 1: The Upper Southampton Township Zoning Ordinance and the Map attached thereto and made a part thereof known as the Zoning Map of Upper Southampton Township, are hereby amended by reclassifying from the R-4  High Density Residential  District to CC Controlled Commercial District the tract of land situate in the Township of Upper Southampton, County of Bucks, Commonwealth of Pennsylvania, consisting of Bucks County Tax Map Parcel No. 48-017-017 as more particularly described in Exhibit A that is attached hereto and fully incorporated herein by reference.

Section 2: The aforesaid Zoning Map of Upper Southampton Township shall be changed, corrected, and marked in accordance with the provisions of this Ordinance so that the same shall hereafter show the hereinabove described tract of land in the Township of Upper Southampton to be classified for zoning purposes from R-4 High Density Residential District to CC Controlled Commercial District.

Section 3: Whenever the requirements of this Ordinance are in conflict with other requirements of the Codified Ordinances of the Township of Upper Southampton, the most restrictive, or those imposing the higher standards shall govern.

Section 4:  The provisions of this Ordinance are severable.  If any section, clause, sentence, part or provision thereof shall be held illegal, invalid or unconstitutional by any court of competent jurisdiction, such decisions of the court shall not impair any of the remaining sections, clauses, sentences, parts or provisions of this Ordinance.  It is hereby declared to be the intent of the Board of Supervisors of Upper Southampton and that this Ordinance would have been enacted if such illegal, invalid or unconstitutional section, clause, sentence, part of provisions had not been included herein.

Section 5.  This Ordinance shall become effective five (5) days after adoption by the Board of Supervisors of Upper Southampton Township.
