Public Notice: Amending ordinances pertaining to Fire Alarm and Fire Prevention

PUBLIC NOTICE

Notice is hereby given that the Board of Supervisors of Upper Southampton Township, County of Bucks, Commonwealth of Pennsylvania, will hold a public hearing on October 1, 2019 at 6:30 PM in the Southampton Free Library, lower level meeting room, 947 Street Road, Southampton, PA 18966 to consider adoption of the following ordinances:

  AN ORDINANCE OF THE TOWNSHIP OF UPPER SOUTHAMPTON, COUNTY OF BUCKS, COMMONWEALTH OF PENNSYLVANIA AMENDING CHAPTER 38 OF THE CODE OF ORDINANCES TITLED “UPPER SOUTHAMPTON FIRE ALARM ORDINANCE” OF THE TOWNSHIP OF UPPER SOUTHAMPTON BY REVISING REGULATIONS PERTAINING TO DEFINITIONS, FINDINGS, AND VIOLATIONS AND PENALTIES

 AN ORDINANCE OF THE TOWNSHIP OF UPPER SOUTHAMPTON, COUNTY OF BUCKS, COMMONWEALTH OF PENNSYLVANIA AMENDING CHAPTER 96 OF THE CODE OF ORDINANCES TITLED “FIRE PREVENTION” OF THE TOWNSHIP OF UPPER SOUTHAMPTON BY REVISING SECTION 96-2 TO CHANGE REFERENCES TO “FIRE CODE OFFICIAL” AND “FIRE CHIEF” TO “UPPER SOUTHAMPTON TOWNSHIP FIRE MARSHAL”

UPPER SOUTHAMPTON TOWNSHIP

BUCKS COUNTY, PENNSYLVANIA

       ORDINANCE NO.         

AN ORDINANCE OF THE TOWNSHIP OF UPPER SOUTHAMPTON, COUNTY OF BUCKS, COMMONWEALTH OF PENNSYLVANIA AMENDING CHAPTER 38 OF THE CODE OF ORDINANCES TITLED “UPPER SOUTHAMPTON FIRE ALARM ORDINANCE” OF THE TOWNSHIP OF UPPER SOUTHAMPTON BY REVISING REGULATIONS PERTAINING TO DEFINITIONS, FINDINGS, AND VIOLATIONS AND PENALTIES

WHEREAS, the Board of Supervisors of Upper Southampton Township adopted the Upper Southampton Fire Alarm Ordinance; and

WHEREAS, the Board of Supervisors of Upper Southampton desires to amend certain regulations pertaining to Definitions (§38.2), Findings (§38.4) and Violations and Penalties; Fines (§38.8).

NOW THEREFORE, the Board of Supervisors of Upper Southampton Township does hereby enact and ordain the following:

 Section 1.  The Code of Ordinances of the Township of Upper Southampton is hereby amended by the deletion of sections identified as Definitions (§38.2), Findings (§38.4) and Violations and Penalties (§38.8) of Chapter 38 titled “Upper Southampton Fire Alarm Ordinance”. In place of the said deleted sections identified as Definitions (§38.2), Findings (§38.4) and Violations and Penalties; Fines (§38.8), the following sections identified as Definitions (§38.2), Findings (§38.4) and Violations and Penalties (§38.8) shall be inserted:

 § 38-2 Definitions.

 As used in this chapter, the following terms shall have the meanings indicated:

 Alarm

 Burglar or Fire Alarm       

ALARM SYSTEM

Any device designed or used for detection of intrusion into a building, structure or facility or for alerting persons of the attempt or commission of a crime or any emergency situation involving potential death or serious injury and which is directly connected to an audible alarm or the transmission of a related signal or message which is used to evoke an emergency response to any address or separate component of any system.

EMERGENCY SERVICES

Police, fire and rescue squad that provide services to persons and properties located in Upper Southampton Township.

NUISANCE BURGLAR ALARM

The activation of a burglar alarm system due to other than said purpose for which the alarm system is designed. Any activation of an alarm system caused by natural catastrophic conditions, as determined by the Township, will not constitute a nuisance alarm.  These alarms are responded to by the Police Department.

NUISANCE FIRE ALARM

The activation of a fire alarm system due to other than said purpose for which the alarm system is designed. Any activation of an alarm system caused by natural catastrophic conditions, as determined by the Township will not constitute a nuisance alarm.  These alarms are responded to by the Emergency Services. 

 § 38-4 Findings.

The Board of Supervisors of Upper Southampton Township finds and declares that:

A.  The majority of alarm system activations to which the Emergency Services and emergency services personnel respond to are false.  False alarms are herewith deemed to be nuisances resulting in a waste of manpower and creating the potential for serious injury to police officers, fire department personnel and other emergency personnel responding to a false alarm; further, when said personnel are responding to false alarms, they are not available for the protection of residents and the general public.

B.  The danger created through emergency responses created by nuisance alarms is unnecessary and hazardous.

C.  The unnecessary expenditure of public revenue through responses to nuisance burglar and fire alarms must be eliminated.

D.  Nuisance alarms have created conditions causing danger and annoyance to the general public.

§ 38-8 Violations and penalties; fines.

Failure to register.  Any person or responsible entity that shall fail to make application or register with Upper Southampton Township prior to the installation or transfer of an alarm system on the premises shall pay to Upper Southampton Township a fine in the amount of $50, plus costs of prosecution.

A.  Nuisance Burglar Alarms – Penalties for Nuisance Burglar Alarms shall be established from time to time by     Resolution of the Upper Southampton Township Supervisors.  Penalties shall be assessed based on violations occurring during any consecutive 12 month period.

B.  Nuisance Fire Alarms – Penalties for Nuisance Fire Alarms shall be established from time to time by Resolution of the Upper Southampton Township Supervisors.  Penalties shall be assessed based on violations occurring during any consecutive 12 month period.

Section 2.     All ordinances or parts of ordinances in conflict herewith are hereby repealed.

Section 3.  That nothing in this ordinance hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section 4 of this ordinance; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this ordinance.

Section 4.        It is the intent of the Board of Supervisors of Upper Southampton that the provisions of this Ordinance shall become and be made a part of the Code of the Township and sections of this Ordinance may be renumbered or relettered and the word “ordinance” may be changed to “section” or “article” or such other appropriate word or phrase in order to accomplish the intention of the Board of Supervisors.

Section 5.        This Ordinance shall take effect and be in full force and effect five (5) days after adoption by the Board of Supervisors of Upper Southampton Township.

WHEREAS, the Board of Supervisors of Upper Southampton Township adopted the 2015 Edition of the International Fire Code; and  

WHEREAS, the Board of Supervisors of Upper Southampton desires to amend the text of the said Code to change all references to “Fire Code Official” and “Fire Chief” to “Upper Southampton Township Fire Marshal”.

 NOW THEREFORE, the Board of Supervisors of Upper Southampton Township does hereby enact and ordain the following:

 Section 1.  The Code of Ordinances of the Township of Upper Southampton is hereby amended by the deletion of §96.2 of Chapter 96, “Fire Prevention”. In place of the said deleted §96.2, the following §96.2 shall be inserted:

  §96.2.        Amendments.

A.  The following sections are hereby revised as follows:

                         Section 101.1. Insert:  Township of Upper Southampton.

                         Section 109.4. Insert:  “summary offense,” “$1,000.00,” “90 days.”

                         Section 111.4. Insert:  “$500.00,” “$1,000.00.”       

B.  All references to “Fire Code Official” and “Fire Chief” in the International Fire Code,         2015 Edition, shall be replaced with “Upper Southampton Township Fire Marshal”.

 Section 2.     All ordinances or parts of ordinances in conflict herewith are hereby repealed.

 Section 3.      Nothing in this ordinance or in the International Fire Code, 2015 Edition, as amended, shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section 4 of this ordinance; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this ordinance.
